A bill that may make it illegal to deliver pornographic content online in Michigan has been introduced by legislators.
The Republican members of the state House of Representatives introduced 4938 last week that would “prohibit the distribution of some material on the internet that destroys the common morals. ”
What’s Included In The Michigan Online Porn Ban?
The main objective of the bill is porn, but it also aims to demonize transgender depictions.
The bill widely defines “pornographic material, “which includes “any content, whether modern, life, streamed, or often distributed on the internet, whose main goal is to sexually arouse or gratify,” as defined by the bill, including videos, erotica, magazines, stories, manga/anime, material created by artificial intelligence, live feeds, or audio clips.
The First Amendment protection appears to be free from the restrictions material in the act. Given that sex is not protected speech under the Constitution, how could the law function properly?
“Prohibited stuff” refers to “material that, in the United States, was not protected by the First Amendment to the Constitution of the United States respecting laws preventing freedom of speech or the media, “according to the law.
The proposed penalties in the bill are severe, with fines of up to$ 100, 000, or both possible sentences. Additionally, it permits civil penalties of up to$ 500,000.
According to the bill, internet service providers would be required to implement “common filtering systems” to “actively monitor and prevent known circumvention tools “and to “block access to specific websites upon receipt of a court purchase.”
To maintain the proposed law, the state attorney general is asked to identify “a unique web content enforcement division” staffed with “digital forensics analysts, legitimate experts, cybersecurity specialists, and investigators.
So far established lawmakers don’t think the act has much of an opportunity to pass.
